ALWAYS check terms for each auction as each auction may have different terms (shipping options, pickup locations/times, etc.) All items are sold "As-Is, Where-Is" with no warranty or claim of merchantability or fitness for a particular purpose. Buyer is solely responsible for previewing items and determination of condition and value. We are not experts on any particular items and provide descriptions only as a courtesy. Buyer's Premium: 15%. Buyer's Premium is included in the total purchase price and therefore subject to any applicable sales tax. Sales Tax: 7% for Local Pickup, Local rate for shipments within Florida, No tax on items shipped out of Florida or on purchased by buyers providing a FLORIDA Sales Tax Exemption Certificate BEFORE auction ends. *Shipping exemption only applies to items shipped via common carrier - if picking up items yourself, you will be charged tax even if you are taking the items out of state, unless a FLORIDA Sales Tax Exemption Certificate is provided.* You agree to pay for all of your successful bids plus buyer's premium, sales tax (if applicable) and any other associated fees outlined in the terms as well as the auction and lot descriptions, including storage fees if items are not removed by the stated removal deadline. Your credit card used to register for the auction will be billed approximately 24 hours after the end of the auction, unless you have already paid in person or by phone using another method. Shipping and/or storage fees will be billed separately if applicable. Preview: Items may be previewed by appointment or as outlined in the Auction Description. Shipping & Pickups: Items may be picked up in person as outlined in the Auction Description. We also provide shipping services as outlined below (not available for all auctions), or you may arrange your own pickup and/or shipping. USPS / UPS / FedEx Shipping is available at our cost plus 10% Handling ($2 Min/$20 Max Handling Fee). There will also be an additional 1% ($1 Minimum) added to cover shipping insurance. We will be happy to assist with arranging freight at buyer's expense for items too large, heavy, dangerous and/or fragile for regular package delivery service. Additional handling and/or material charges will apply. Shipping is calculated and charged separately and after your invoice for items, fees and taxes has been paid in full. If you are unable to pick up your items during removal times and by the removal deadline, and do not make arrangements for shipping, a storage fee of $20 per day will be charged starting with the day after the removal deadline. You may avoid storage fees by paying for your items by the payment deadline, and notifying us by the removal deadline that you wish to abandon your items. Abandoned items will be disposed of or resold at our discretion without compensation to the buyer. Non-paying bidders will be banned from our auctions, and we reserve the right to share this information with other auctioneers directly and/or through our auction platform, and that information may be used to prevent you from bidding on their auctions as well. You must be at least 18 years old to bid YOU MUST REGISTER for online bidding for each auction. Once you have set up your HiBid account, you will not have to re-enter your information each time. You must provide a valid credit card. The card you submit when registering for each auction will be charged at the conclusion of that auction unless you notify us before the end of the auction that you would like to pay in person. In-person or phone payments must be made within 24 hours of auction end or card on file will be charged. In the event that payment is not made and credit card is declined, buyer will be responsible for collection costs, storage fees (see above), court costs and/or attorney's fees as needed in order to collect payment. Staggered Closings: Auctions typically will have staggered closings (one item closing every so many seconds) starting at a specific time. To emulate a "live" auction, bidding will be extended on each item, as needed, until there have been no bids for a set period of time (usually 3 minutes). Tie Bids: In the event of identical bid amounts from multiple bidders, the earlier bid will take precedence. If you are the winning bidder in tie for the high bid, and increase your bid, your bid may be raised to the next increment, even though you are already the current 'winning' bidder. All Items Selling "as is, where is." All Sales are Final - No Refunds! You are bidding ONLY on the item(s) as described in the Online Catalog and NOT as the lot seems to appear in photograph(s). Buyer is solely responsible for inspection and determination of value. Once an item is called sold it will immediately become the responsibility of the buyer. We cannot be held liable for any damage or theft of the item. If we are shipping your item for you by USPS, UPS or FedEx, you will be required to pay for insurance on the shipping. Should damage occur during shipping you will need to contact the shipper to make a claim. Unless shipping arrangements are made, you are responsible for all costs associated with removal and any damage to the Auction site or other items, as well as providing the necessary boxes, packing materials, equipment and labor necessary to safely remove your items. No item will be released without a PAID-in-FULL invoice listing the item(s) purchased. If you are Outbid, you may receive an e-mailed notice. These notices are not sent in the closing minutes of the auction. Auctioneer is not responsible for delayed and/or undelivered e-mails. The Auctioneer's decision on all disputes and related matters is final. Both Auctioneer and Seller reserve the right to make changes to and/or remove any lot(s), prior to the Auction closing. Auctioneer and Seller liability shall be limited to the return of any monies paid by the Buyer. All Bidders agree to indemnify and hold harmless the Auctioneer and Seller, their agents and representatives, from and against all liability, claims, suits or causes of action from participation in, purchase and/or removal of items at this Auction. All disputes that may arise by virtue of and/or under the contractual relationship by and between the parties to this agreement will be governed by the laws of the State of Florida. The venue of any legal action that may arise between the parties to these agreements and/or the auction proceedings conducted by Florida Surplus Auctions will be in Pasco County, Florida. Any cause of action and/or suit of any kind arising between the parties hereto (to include auctioneer, auction company, consignor or purchasers of goods at auction) must be commenced within one (1) year from the date the cause of action accrues or it will be forever barred. The right of action or suit will accrue and the one (1) year limitation period will begin to run, on the date of the breach, damage or injury is sustained and not when the resulting cost, damage, harm or loss is discovered.
