All Bidders Must Read Persons attending previews, sale assume all risks of damage or loss to person/property and specifically release the Auctioneer and Auction Company from any claims arising from attendance of said auction. ALL BIDS ACCEPTED ARE SUBJECT TO BIDDERS APPROVAL. STATEMENTS MADE THE DAY OF AUCTION TAKE PRECEDENCE OVER THE PREVIOUS PRINTED MATERIALS OR ANY ORAL STATEMENTS. To bid a property up for auction, potential bidders will be required to register with the auction company. Registration requires a cash $20,000 refundable deposit (unless otherwise indicated), valid driver's license/State ID, phone #, and last 4 digits of social security or FEI #. A buyer's premium of 3% will be applicable to all purchases at this auction. All sales are final. Property is sold in "AS-IS, WHERE-IS" condition. Inspection of property sold is to be the sole responsibility of the buyer. All information, whether oral or written, as derived from sources believed to be correct are NOT guaranteed. The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of the seller and to reject the bidding of any person whose conduct, actions, or adverse comments are not in the best interest of the seller. The Auction Company reserves the right to withdraw any item from the auction prior to the sale. In case of a disputed bid the decision of the auctioneer shall be final. Buyer will close on property within 15 days with Seller's Title Company. Final Payment is due at closing, payable by Cash or Hard Money and deposited as directed by the Title Company. If Buyer is unable to close within 15 days, Buyer is considered in default unless otherwise agreed upon with the Seller. Buyer will forfeit all deposits if in default. No claims will be allowed. Buyer does hereby waive the right to trial by Jury in respect to any action or litigation that arises in connection with this Auction contract or the auction itself. Disputes arising under this contract will be governed by the laws of the State of Florida. BIDDERS AND OTHERS ATTENDING THIS AUCTION AGREE THAT THEY HAVE READ AND FULLY UNDERSTAND THESE TERMS AND AGREE TO BE BOUND HEREBY.
